Important Information - New eBay User Agreement

Dear Anshu Prateek,

You are receiving this because you are a registered user of an eBay website ("eBay") and you have provided a registration address in India.

Currently your "eBay" site of registration (that is the site on which you registered) is www.ebay.in and You have contracted with eBay International AG, a company incorporated under the laws of Switzerland and having its registered office at Helvetiastrasse 15 /17C H-3005, Bern, Switzerland. If You sell on "eBay", You receive an invoice from eBay International AG for Your activities like listings, various features, final value fees etc.

With effect from 00:00 hours (India Standard Time) on the 1st day of April, 2010, all eBay users with a registration address located in India, will need to be registered with eBay India Private Limited (and not longer with eBay International AG). This means your existing User Agreement with eBay International AG will be terminated as of 31st March 2010 at 23:59 hours (You shall no longer be registered with eBay International AG) and immediately afterwards (i.e. effective 1st April 2010, unless you choose not to accept it, you shall be bound by a new User Agreement with eBay India Private Limited, a company incorporated under the Companies Act, 1956 (as applicable in India) with its registered office at 101-B, Akruti Corporate Park, LBS Marg, Kanjurmarg (West), Mumbai 400079, Maharashtra (INDIA) and the Privacy Policy of www.ebay.in. eBay India Private Limited would raise invoices to You for your activities like listings, various features, final value fees etc. on "eBay".

If you are registered with www.ebay.in, your new User Agreement with eBay India Private Limited and the Privacy Policy of www.ebay.in are hyperlinked as under. Please click on the following hyperlinks to carefully and fully read and understand your new User Agreement and Privacy Policy:

If you are registered with any other eBay website, while your existing user agreement with eBay International AG will be terminated as of 31st March 2010 at 23:59 hours, you shall be subject to the same user agreement of your registration site effective 1st April 2010, except for the following:

  1. Your contract is with eBay India Private Limited. eBay India Private Limited would raise invoices to You for your activities like listings, various features, final value fees etc. on "eBay".
  2. The following clause in the Section "Fees and Services" or "Fees", as the case may be:
    If you reside in India and you select to receive Your invoice in a currency other than Indian Rupees, you will receive all invoices from eBay India Private Limited in the currency as selected by you. You shall make the payments of these invoices in the name of eBay International AG, a company incorporated under Swiss laws and having its principal place of business at Helvetiastrasse 15/17, CH-3005 Bern, Switzerland. Your payments to eBay International AG should be in a currency other than Indian Rupees and should be from a bank account other than an Indian bank account or from a credit card other than those issued by Indian banks. You shall be solely responsible for compliance of all applicable laws including those in India for making payments to eBay International AG. Your payment to eBay International AG with full compliance of all applicable laws shall be sufficient to discharge you from your obligations towards eBay India Private Limited regarding payments under these invoices.

In the new User Agreement, as applicable to you, you would notice that the significant changes are (a) change in the contracting entity from eBay International AG to eBay India Private Limited; (b) eBay India Private Limited would raise invoices to you for your activities including selling and listings on any eBay website; and (c) your payment to eBay International AG for the invoices raised by eBay India Private Limited in non-Indian currency. Once these changes take place, you would continue to have the same world-class experience and protections in transacting on eBay websites that you always had.

Please note the following:

  1. If you agree and accept the aforesaid new User Agreement as applicable to you and with eBay India Private Limited and the Privacy Policy of www.ebay.in, then no further action from your side is necessary and effective 1st April 2010, all Your activities including selling and listings on "eBay" shall be governed by the User Agreement and Privacy policy mentioned above.

  2. If you do not wish to accept the aforesaid new User Agreement as applicable to you with eBay India  Private Limited and the Privacy Policy of www.ebay.in, you can choose to request to close your eBay account permanently on or before 31st March, 2010. Once you close your eBay account: (i) Your eBay account cannot be reopened, (ii) You cannot use the related feedback and (iii) You will not be able to use this user ID or email address on eBay .

  3. Please note that if you do not close your eBay Account permanently before 31st March 2010, as aforesaid, it shall be deemed that you have accepted the User Agreement as applicable to you with eBay India Private Limited and the Privacy Policy of www.ebay.in.
